Terms and Conditions of Use

The Lactation Collection

Welcome to The Lactation Collection. These Terms of Use (“Terms”) govern your use of The Lactation Collection website, online forms, scheduling links, digital resources, educational materials, classes, support groups, events, telehealth resources, and related online services.

The Lactation Collection is a DBA name of Prenatal Insights, LLC (“The Lactation Collection,” “Company,” “we,” “us,” or “our”). By accessing or using this website, submitting a form, scheduling a service, purchasing a class or resource, participating in an event, or using any online service provided by The Lactation Collection, you agree to these Terms.

If you do not agree to these Terms, please do not use this website or related online services.

Website Information Is Educational Only

Information provided on this website, including blog posts, handouts, videos, downloads, social media content, emails, class descriptions, service descriptions, FAQs, and other educational materials, is provided for general informational and educational purposes only.

Website information is not a substitute for individualized lactation care, medical advice, diagnosis, treatment, prescriptions, emergency care, or care from your own healthcare provider.

Use of this website does not create a provider-patient relationship, clinician-client relationship, lactation consultant-client relationship, or duty to diagnose, treat, monitor, or follow up.

A provider-patient or clinical care relationship is created only when you schedule and receive services from The Lactation Collection or one of its approved providers, complete required consent and intake forms, and the provider agrees to provide care.

Lactation and IBCLC Services

The Lactation Collection provides lactation education, assessment, care planning, counseling, and support within the scope of practice of an International Board Certified Lactation Consultant (IBCLC) or other approved lactation provider.

IBCLC services alone are not a substitute for medical care. IBCLCs who are not separately licensed medical providers do not diagnose medical conditions, prescribe medications, order labs, independently treat medical conditions outside their scope, alter a medical provider’s treatment plan, or represent themselves as physicians, nurse practitioners, certified nurse-midwives, or other licensed medical providers.

If your lactation consultant identifies symptoms, assessment findings, or concerns that may require medical evaluation, diagnosis, treatment, prescriptions, labs, urgent care, emergency care, or care outside the consultant’s scope, you may be referred to an appropriate healthcare provider.

Licensed Medical Services When Applicable

Some services offered by The Lactation Collection, Prenatal Insights, LLC, or related service lines may be provided by a licensed healthcare provider, such as a Certified Nurse-Midwife (CNM), Women’s Health Nurse Practitioner-Board Certified (WHNP-BC), Advanced Practice Registered Nurse (APRN), Registered Nurse (RN), or other licensed professional.

Medical services, including diagnosis, treatment, lab orders, lab review, prescriptions, medication counseling, referrals, physical assessment, procedures, or medical follow-up, are provided only when you are specifically scheduled with and receiving care from a licensed healthcare provider who has the education, certification, licensure, scope of practice, liability coverage, and legal authority to provide those services.

Nothing on this website guarantees that any specific medication, prescription, lab order, diagnosis, treatment, referral, procedure, supplement, device, or service will be provided. Clinical decisions are made by the licensed provider based on assessment, history, risks, benefits, scope of practice, applicable law, payer requirements, and clinical appropriateness.

Emergency and Urgent Care

The Lactation Collection does not provide emergency medical care.

Secure messages, emails, texts, phone calls, website forms, social media messages, online scheduling requests, and other communications are not monitored for emergencies or urgent medical concerns.

If you or your baby has an urgent or emergent concern, call 911, go to the nearest emergency department, or contact your or your baby’s medical provider.

The Lactation Collection is not responsible for providing urgent or emergent care outside of scheduled consultations.

Telehealth

The Lactation Collection may offer telehealth services, virtual consultations, virtual classes, or online support through Company-approved platforms.

Telehealth may include limitations, including technology issues, connection problems, privacy risks, and limitations in physical assessment. Telehealth may not be appropriate for every lactation, infant feeding, pregnancy, postpartum, gynecologic, hormone, medication, lab, or medical concern.

The Lactation Collection may recommend an in-person visit, lab testing, imaging, referral, urgent care, emergency care, or evaluation by another healthcare provider when appropriate. Telehealth services may also be limited by state licensure requirements, payer requirements, clinical appropriateness, and applicable law.

No Guarantee of Outcomes

The Lactation Collection does not guarantee any specific breastfeeding, pumping, milk supply, infant feeding, latch, pain, weight gain, bottle-feeding, weaning, pregnancy, postpartum, gynecologic, hormone, fertility, contraceptive, medication, lab, wellness, weight, emotional, financial, or clinical outcome.

Care plans, recommendations, prescriptions, lab orders, classes, support groups, handouts, and educational resources are intended to support informed decision-making and individualized care, but no outcome is promised or guaranteed.

User Responsibilities

By using this website or receiving services from The Lactation Collection, you agree to provide accurate, complete, and current information when submitting forms, scheduling services, communicating with the Company, providing health history, providing insurance information, or making payments.

You are responsible for updating your contact information, payment information, insurance information, health history, medication list, allergies, pregnancy or postpartum status, infant feeding status, and other information relevant to care.

You agree not to submit false, misleading, incomplete, unlawful, abusive, harassing, threatening, defamatory, or inappropriate information through this website, forms, communication systems, social media, or other Company systems.

Scheduling, Forms, and Services

Scheduling a consultation, class, support group, event, or other service may require completion of intake forms, consent forms, payment policies, insurance information, telehealth consents, or other required documents.

The Lactation Collection reserves the right to decline, cancel, reschedule, modify, or refer services when appropriate, including for safety concerns, incomplete forms, incomplete payment or insurance information, scope-of-practice concerns, provider availability, clinical appropriateness, or other operational reasons.

Service availability may vary by provider, location, service area, visit type, modality, payer requirements, clinical need, and applicable law.

Payment, Insurance, and Financial Responsibility

Payment, insurance billing, eligibility verification, claim denials, copays, deductibles, coinsurance, cancellation fees, late fees, travel fees, urgent/same-day fees, weekend or holiday fees, multiples fees, continued support fees, refunds, and reimbursement are governed by The Lactation Collection’s current Payment, Insurance, and Financial Responsibility Policy, Consent for Care, booking terms, or other applicable client-facing financial agreement.

Insurance coverage is not guaranteed. The Lactation Collection may bill certain eligible insurance plans through The Lactation Network, Wildflower Health, and/or DMBA when eligibility requirements are met and all required forms and information are completed.

Clients are responsible for verifying their own insurance benefits, coverage limits, copays, deductibles, coinsurance, visit limits, and plan-specific requirements. The Lactation Collection cannot guarantee claim approval, reimbursement, number of covered visits, payer payment, or the absence of client financial responsibility.

If required forms, insurance information, demographic information, payment information, or payer-specific requirements are incomplete, inaccurate, delayed, outdated, or not submitted before the visit, The Lactation Collection may be unable to bill insurance, and the client may be responsible for payment at the self-pay rate or other amount permitted by applicable payer agreement and law.

Payment Platforms and Payment Notes

Accepted payment methods may include credit/debit cards, HSA/FSA cards, Company-approved Venmo, cash if accepted under Company policy, or other Company-approved payment methods.

Some payment platforms, including Venmo, may not be HIPAA-compliant. If you choose to pay through Venmo or another non-HIPAA payment method, you understand this may disclose that you received services from The Lactation Collection.

Do not include protected health information, diagnoses, clinical details, feeding concerns, visit details, or other health information in Venmo descriptions, payment notes, or other payment messages.

Privacy

Use of this website and services is also governed by The Lactation Collection’s Privacy Policy and, when applicable, any HIPAA Notice of Privacy Practices.

By using this website, submitting forms, communicating with The Lactation Collection, scheduling services, or receiving services, you acknowledge that information may be collected, used, disclosed, and protected according to the Privacy Policy, applicable consent forms, applicable HIPAA requirements, and applicable law.

Do not submit urgent medical concerns, emergency messages, sensitive health details, or protected health information through website forms, social media, payment notes, or other non-secure methods unless specifically instructed to do so through a Company-approved system.

Photos, Videos, Classes, Support Groups, and Events

The Lactation Collection may take general photographs or videos during public classes, support groups, community events, trainings, or other group offerings for documentation, education, website, social media, marketing, or promotional purposes.

By attending a public class, support group, community event, training, or group offering, attendees understand that general event photography or videography may occur. These photos or videos may include group photos, crowd images, room or activity photos, class participation, event setup, educational activities, or other general event content.

The Lactation Collection will make reasonable efforts to avoid using images in a way that discloses private health information, sensitive clinical details, or individualized care information.

Attendees who do not want themselves or their child photographed or recorded should notify The Lactation Collection before or during the event. The Lactation Collection will make reasonable efforts to avoid photographing or publishing identifiable images of individuals who opt out.

Separate written authorization may be requested for close-up images, testimonials, client stories, individual care-related content, images used in a way that highlights a specific client or child, or any use involving identifiable health information, case details, clinical circumstances, or sensitive personal information.

Social Media

The Lactation Collection’s social media accounts are for general education, marketing, and community connection only. Social media content is not individualized lactation care, medical advice, diagnosis, treatment, prescription guidance, lab interpretation, emergency advice, or a substitute for a consultation.

The Lactation Collection does not provide direct clinical support, diagnosis, treatment, prescriptions, medication changes, lab interpretation, or emergency care through social media comments or direct messages.

Do not send protected health information, urgent concerns, private medical details, photos, videos, lab results, prescription questions, or emergency messages through social media.

Email and Marketing Communications

If you choose to receive marketing or educational emails from The Lactation Collection, you may receive educational resources, updates, class information, event information, service announcements, or support resources.

Marketing emails are not used for urgent or clinical communication. You may unsubscribe from marketing emails at any time.

Intellectual Property

Unless otherwise stated, all text, graphics, logos, images, videos, handouts, downloads, course materials, website content, blog posts, forms, templates, educational materials, and other content on this website are owned by or licensed to The Lactation Collection.

You may view and use website content for personal, non-commercial purposes only. You may share public website links, but you may not copy, reproduce, distribute, modify, publish, sell, teach from, create derivative works from, or use The Lactation Collection materials for commercial purposes without written permission.

You may not use The Lactation Collection’s name, logos, trademarks, branding, handouts, course materials, website content, social media content, or other intellectual property in a way that suggests endorsement, affiliation, ownership, or authorization without written permission.

Prohibited Uses

You agree not to use this website or related services to:

  • Violate any law, regulation, or third-party right
  • Submit false, misleading, defamatory, abusive, threatening, harassing, obscene, or unlawful content
  • Attempt to gain unauthorized access to Company systems, client information, accounts, forms, or platforms
  • Upload malware, viruses, spam, or harmful code
  • Interfere with website functionality, security, or availability
  • Copy, scrape, reproduce, or misuse website content or Company materials
  • Misrepresent your identity, eligibility, insurance information, payment information, or relationship to another person
  • Use Company materials for competing, commercial, or unauthorized purposes
  • Submit another person’s information without appropriate authority or consent

Third-Party Links and Resources

This website, emails, handouts, social media content, or educational materials may include links to third-party websites, products, services, referral providers, labs, pharmacies, platforms, or resources.

The Lactation Collection does not control third-party websites, products, services, privacy practices, policies, pricing, availability, safety, quality, insurance coverage, or outcomes. Third-party links and references are provided for convenience, education, care coordination, or client support only and do not guarantee any specific result.

Affiliate Disclosure

The Lactation Collection may participate in affiliate programs. Some links on this website, in blog posts, emails, handouts, social media content, or educational materials may be affiliate links. This means we may earn a commission if you purchase a product through one of our links, at no additional cost to you.

Affiliate relationships do not replace individualized clinical recommendations. Product availability, pricing, safety, suitability, and effectiveness may vary. Clients are responsible for deciding whether a product is appropriate for their needs and should consult a healthcare provider when needed.

Limitation of Liability

To the fullest extent permitted by law, The Lactation Collection, Prenatal Insights, LLC, and their owners, providers, contractors, employees, representatives, affiliates, and service providers are not liable for damages arising from your use of, or inability to use, this website, online resources, third-party links, educational materials, social media content, or non-clinical communications.

Nothing in these Terms is intended to limit liability in a way that is prohibited by applicable law or to alter rights or responsibilities that may apply under a signed client agreement, Consent for Care, HIPAA Notice of Privacy Practices, or other applicable written agreement.

Indemnification

You agree to indemnify and hold harmless The Lactation Collection, Prenatal Insights, LLC, and their owners, providers, contractors, employees, representatives, affiliates, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the website, violation of these Terms, submission of inaccurate or unauthorized information, violation of another person’s rights, or unlawful conduct.

Changes to These Terms

The Lactation Collection may update these Terms from time to time. The updated version will be posted on this website with a revised “Updated” date. Continued use of the website or services after an update means you acknowledge the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
